Legal Pathways handles your personal data with the upmost diligence complies with applicable data protection and privacy laws. This Privacy Notice covers the processing of your personal data by Legal Pathways.

Identity and contact details of Controller, Processor

Legal Pathways is responsible for collecting and processing your personal data as a controller when you visit our website. If you contact us in our capacity as representative of a controller or processor located outside the EU, Legal Pathways is processor of your personal data for the controller or processor you seek to contact. You can contact Legal Pathways via the contact form of this website or the contact form on the website of the controller or processor located outside the EU whom you intend to contact and for whom Legal Pathways is the legal representative in the EU.

Which personal data we collect

Legal Pathways processes the personal data you provide us with when you contact us using the contact form on this website or the contact form on the website of the controller or processor located outside the EU whom you intend to contact and for whom Legal Pathways is the legal representative in the EU – your e-mail address, your name and your message -, and, where applicable, any information which is legally required for your identification as well as personal data from other sources, as, if, when and to the extent necessary to handle your request.

Purposes and legal bases for our processing of your personal data

Legal Pathways uses your personal data for the purpose of handling your request, with your specific consent, to the extent necessary for the execution or entering into of an agreement with the controller or processor located outside the EU to which you are a party, to comply with regulatory and legal obligations especially regarding data protection, to the extent necessary for the protection of a legitimate interest of us or a third party, including the legitimate interest of the controller or processor who is the addressee of your request to handle your request and for purposes of improvement of quality and security of its processing activities.

Retention period

Legal Pathways retains your personal data for as long as we need it for the fulfilment of the abovementioned purposes and as, if, when and to the extent permitted or required under the applicable statutory laws. Upon expiration of the last applicable contractual and statutory retention period for the data concerned, we will either anonymize your personal data or have it deleted.

Sharing your personal data

In case you submit a request with respect to the processing activities of a controller or processor located outside the EU whom we represent as its EU representative under the GDPR, we are required to forward your request to said controller or processor outside the EU and so transfer your personal data to them, so they can handle your request. We forward your personal data to said controller or processor outside the EU either on the basis of an EU adequacy decision for the country concerned or, in the event no adequacy decision exists for the country concerned, on the basis of your explicit consent to such transfer. We hereby inform you of the possible risks of this transfer of your personal data for you, due to the absence of an adequacy decision and appropriate safeguards in the country of said controller or processor outside the EU. By sending us your request, you explicitly consent to our forwarding of your personal data to said controller or processor outside the EU for the purpose of handling your request.

As, if, when and to the extent required to comply with legal or regulatory requirements or to handle your request, we may or must also share your personal data, with regulatory authorities or courts or third party service providers contracted by Legal Pathways, such as translators, legal advisers or providers of IT services. All processing of your personal data by any third party service provider we engage, will take place pursuant to the applicable contracts and satisfy data protection laws.

Protection of your personal data

Legal Pathways uses a variety of technical and organizational measures to help protect your personal data from unauthorized access, disclosure, modification, loss or destruction in accordance with applicable data protection laws.

Your rights with respect to your personal data

Right to access. You have the right obtain from us confirmation as to whether or not Legal Pathways processes personal data concerning you, and, where that is the case, access to the personal data and the following information:

(a) the purposes of the processing;

(b) the categories of personal data concerned;

(c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;

(d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;

(e) the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;

(f) the right to lodge a complaint with a supervisory authority;

(g) where the personal data are not collected from the data subject, any available information as to their source;

(h) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

Where personal data are transferred to a third country or to an international organisation, you shall have the right to be informed of the appropriate safeguards relating to the transfer.

Right to rectification. You have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

Right to erasure. You have the right to obtain from us the erasure of your personal data without undue delay and we shall have the obligation to erase your personal data without undue delay where one of the following grounds applies:

(a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

(b) you withdraw the consent on which the processing is based according to point (a) of Article 6(1), or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing;

(c) you object to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Article 21(2) of the GDPR;

(d) the personal data have been unlawfully processed;

(e) the personal data have to be erased for compliance with a legal obligation in European Union or Member State law to which Legal Pathways is subject;

(f) the personal data have been collected in relation to the offer of information society services referred to in Article 8(1).

Right to restriction of processing. You have the right to obtain from us restriction of processing where one of the following applies:

(a) you contest the accuracy of your personal data, for a period enabling us to verify the accuracy of the personal data;

(b) the processing is unlawful and you oppose the erasure of your personal data and request the restriction of their use instead;

(c) we no longer need your personal data for the abovementioned purposes of our processing, but they are required by you for the establishment, exercise or defense of legal claims;

(d) you have objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of us or a third party override your rights.

Right to data portability. You have the right to receive your personal data, which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from us, where:

(a) the processing is based on consent pursuant to point (a) of Article 6(1) or point (a) of Article 9(2) of the GDPR or on a contract pursuant to point (b) of Article 6(1) of the GDPR; and

(b) the processing is carried out by automated means.

Right to object and automated decision-making. You have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on point (e) or (f) of Article 6(1) of the GDPR, including profiling based on those provisions.

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

Right to withdraw your consent. You have the right to withdraw your consent to the processing of your personal data by Legal Pathways at any time. Your withdrawal of consent shall not affect the lawfulness of processing based on your consent before your withdrawal thereof.

Right to complain. You have the right to complain to a competent supervisory authority

Please be advised that your rights listed above are not absolute and may be subject to exemptions, exceptions, conditions and/or restrictions.

No mandatory provision of personal data

Your providing of your personal data to Legal Pathways is neither a statutory nor a contractual requirement, nor a requirement necessary to enter into a contract, and you are not obliged to provide your personal data to us. If you do not provide your personal data to us, we cannot process your request.

No sale

Legal Pathways will not license, sell or encumber your personal data.
